Terms and Conditions

The rules, rights and obligations related to use of KabinMemuru.tr, including access to courses, digital content and recruitment preparation services for cabin crew candidates in Turkey.

  1. General provisions
    1. These Terms and Conditions set out the rules for using the website operated at www.kabinmemuru.tr (hereinafter the "Service", "Application" or "KabinMemuru.tr"), operated by Pro Wojciech Cywinski (hereinafter "PWC" or "Provider"), ul. Bernardyńska 23/65, 02-904 Warsaw, Poland, registered in the CEIDG business register under NIP: 5213369140, REGON: 141055055.
    2. The Service allows users to browse online offers of services provided by KabinMemuru.tr and to order available Products — in particular in-person and/or online courses, digital products supporting airline recruitment processes, including individual and group recruitment exercises, as well as training materials in question-and-answer form on recruitment stages, including the Final Interview.
    3. Use of the Service is free of charge.
    4. These Terms and Conditions define the rights and obligations of KabinMemuru.tr and users of the Service. PWC provides services within the Service in accordance with these Terms.
    5. Use of the Service constitutes acceptance of these Terms. Every user must read the Terms before starting to use the Application. A user who does not accept these Terms must stop using the Service.
    6. The user may not publish unlawful content on the Service.
    7. PWC does not provide telecommunications services within the meaning of applicable law. Any complaint relating to such services must be addressed by the user to the telecommunications operator whose services they use.
  2. Definitions
    1. Service — the KabinMemuru.tr website, also referred to as the "Application", "Service" or "KabinMemuru.tr", at www.kabinmemuru.tr, operating on an online platform owned by PWC, comprising a set of information and sales pages as well as graphic elements and the complete IT system architecture.
    2. User — a person using the Service. A user may be an adult with full legal capacity, or a minor with the consent of a legal representative.
    3. Product, also referred to as Service — a service or digital content provided by PWC within the Service — such as an e-learning course, webinar, individual or group recruitment exercises, training materials in question-and-answer form on the recruitment process (including Final Interview), or outside the Service — such as an in-person course.
    4. Payment operator — an external service handling payments (e.g. PayU, Przelewy24 or other). The payment operator acts under its own terms and privacy policy. It provides services to PWC under a separate agreement.
    5. Order — selection of a product on the Service and payment via the chosen payment operator. A paid order equals conclusion of the service contract between PWC and the User. Failure to pay equals cancellation of the order.
  3. Technical requirements
    1. Use of the Service requires a device with Internet access and a browser capable of displaying web pages, JavaScript and cookies. Use of the latest supported browser versions from their publishers is recommended.
    2. For Products constituting digital content or services delivered online, the User must have hardware and software allowing the content to be read or displayed (e.g. PDF files, videos or web pages) in line with the Product description. The Provider does not guarantee proper operation of the Service and Products on unsupported or outdated devices or browsers.
    3. The Provider informs that technical problems or limitations on the User's device or in their network environment (firewall, blocks, antivirus, browser settings, missing updates, ISP limitations) may limit or prevent access to the Service or use of the Products.
  4. Service access rules
    1. Use of the Service may depend on installing software required by the provider of the User's fixed or mobile operating system, or on its updates.
    2. Proper operation of the Service may also require installation of updates or patches to applications provided by PWC.
    3. Internet connection costs are borne by the User under their contract with the telecommunications operator.
    4. The User acknowledges that in some locations, due to poor or absent Internet connection, the Service may not work correctly or may be unavailable.
  5. Intellectual property and licences
    1. PWC holds all intellectual property rights to the Service, in particular to the name, domain, layout, graphic elements and all other creative elements of KabinMemuru.tr.
    2. Upon opening the Service on the User's fixed or mobile device, PWC grants the User a non-exclusive, perpetual licence to use the Application and its resources to browse content and place orders on KabinMemuru.tr. PWC reserves the right to terminate the licence without notice if the User breaches these Terms.
  6. Use of the Service
    1. Use of the Application is voluntary.
    2. The Application is intended for natural persons with full legal capacity or minors as defined under User.
    3. Placing an order via the Service is possible after registration without login. PWC encourages Users to register. Certain services or elements of the Service may be reserved for registered Users.
    4. To register, the User must provide an active email address, first name, surname and mobile phone number. To create an account and log in, the User must also provide postal details and a unique password, and complete the verification procedure indicated by PWC.
    5. If registration succeeds without a login option, PWC will create an internal profile for service delivery to which the User will not have permanent access. Any change of data for a guest order must be made by contacting the person managing KabinMemuru.tr directly or by email: support@kabinmemuru.tr.
    6. If registration with login is verified successfully, PWC will create a User profile in the Service where settings and data provided during registration will be stored. The User will have permanent access to their data via login. This data will not be visible to other Users.
    7. To place an order, an unregistered User must provide first name, surname, active email address and phone number, and complete the order form with preferences, available dates and required consents.
  7. Scope of PWC activity within the Service
    1. PWC may publish offers of its own products and those of third parties on the Service.
    2. PWC may publish advertisements and other promotional content for third-party goods and services on the Service.
    3. PWC endeavours to ensure proper operation of the Service but does not guarantee continuous availability. PWC may temporarily suspend the Service when necessary to fix faults or improve operation.
    4. PWC reserves the right to delete profiles inactive for at least six months.
    5. PWC reserves the right to intervene on a user profile to correct Service faults or profile issues.
    6. Any attempt to hack the Service, bypass codes or use it in breach of these Terms may result in immediate and irreversible blocking of access to the Service and appropriate legal action.
    7. PWC reserves the right to cease providing services and shut down the Service at any time.
  8. Service provision rules
    1. Use of the KabinMemuru.tr Service is free of charge.
    2. Ordering a Product via the Service requires payment and registration.
    3. All Product prices are gross prices at the applicable VAT rate. The price shown for each Product in the Service is binding on the User and PWC at the time the order is placed and paid.
    4. PWC reserves the right to change Product prices, run temporary promotions and discounts, subject to acquired rights and applicable law. Promotions and discounts do not combine. Changes do not apply to Products already purchased.
    5. The following Products are available in the Service: (1) "KabinMemuru.tr Course" Product, also referred to as "Course", an in-person course for a group on a date and location chosen from the calendar, or an online course where indicated; (2) "Recruitment Exercises" Product — sets of exercises in individual or group versions, preparing for airline recruitment stages, provided as digital content; (3) "Final Interview – questions and answers" Product — training materials as digital content (questions, answers and commentary on the final recruitment stage).
    6. Orders via the Service are processed by an external payment operator and booking system.
    7. PWC undertakes to provide services of the highest quality, based on up-to-date knowledge and conditions in the cabin crew recruitment market.
    8. PWC may cancel the Service if insufficient places are sold or due to organisational or technical problems. If PWC cancels a course date, all Users who purchased the Product will be refunded.
    9. The KabinMemuru.tr Course programme is based on information from airlines and the experience of Instructors (Emirates, Etihad, Qatar Airways, Turkish Airlines and Pegasus, Ryanair, easyJet and other airlines.).
    10. Instructor selection is based on professional experience criteria guaranteeing the quality of services provided by PWC.
    11. KabinMemuru.tr Instructors are trained according to the course programme to maintain quality and consistency of content across locations in Turkey and abroad.
    12. Digital products, including recruitment exercises and "Final Interview – questions and answers", are educational and simulation in nature. PWC does not guarantee that questions, exercises or scenarios will appear in the actual recruitment process of airlines.
    13. PWC does not guarantee the User employment with an airline after completion of the Service.
    14. PWC does not guarantee the User success in recruitment with chosen airlines.
    15. PWC guarantees that materials, the programme and cabin crew recruitment knowledge are accurate and effectively help the User succeed in the recruitment process.
    16. The programme does not infringe the rights or internal procedures of airlines regarding cabin crew recruitment.
    17. PWC is not responsible for airlines' formal requirements or changes to them.
    18. PWC is not responsible to the User vis-à-vis their future employer in the aviation sector.
    19. PWC does not train the User in aircraft technical procedures, first aid or airlines' internal procedures.
    20. PWC is not responsible for changes in the recruitment process made by carriers worldwide during or after performance of the Service.
    21. PWC may refuse to perform the service when: (1) the User uses the service for improper purposes or to the detriment of third parties or PWC; (2) the User breaches the law or these Terms.
    22. The User may not copy in whole or in part the materials and knowledge provided (slides, printed documents, videos, etc.) or present or distribute them. In case of breach, PWC may claim the contractual penalties set out herein (10,000 PLN net + VAT per breach).
    23. PWC reserves the right to modify Products and rules of use in the Service, provided that Products already purchased remain governed by the rules and dates chosen at order.
    24. PWC reserves the right to modify penalties for breach of copy, presentation and distribution rights referred to in point 8.7.
    25. Under these Terms, the User may not carry on competing activity or be employed by a PWC competitor for 12 months from the last service provided by PWC.
    26. The User has a right of withdrawal without giving a reason within 14 days of purchasing the Product (conclusion of the contract between PWC and the User). This right applies both to the KabinMemuru.tr Course (in-person or online course) and to digital products (Recruitment Exercises, Final Interview – questions and answers).
    27. To withdraw, the User sends a clear withdrawal statement to: Pro Wojciech Cywinski, ul. Bernardyńska 23/65, 02-904 Warsaw, marked "Withdrawal", or by email to: support@kabinmemuru.tr, stating the Product concerned (course or digital product) and the data provided at registration. Signature (post only). For the Course (in-person or online course): withdrawal is conditional on non-use of the Product; a course already attended does not entitle to refund. For digital products (Recruitment Exercises, Final Interview – questions and answers): the User acknowledges that they lose the right of withdrawal once they have accessed the content (opening, downloading or making tasks or materials available), subject to having consented to start of performance before expiry of the 14-day period and having been informed. There is no refund once the User has accessed tasks or other digital content. A paid and performed service does not entitle to refund. The User may submit a complaint for defective service.
    28. It is sufficient for the User to send the withdrawal statement before expiry of the 14 days following payment of the order to preserve the withdrawal period.
    29. Effects of withdrawal: in case of withdrawal, the User will be refunded without delay, and in any event no later than 14 days after the Provider is informed.
    30. The consumer benefits from statutory conformity guarantees (Articles L.217-4 et seq. of the French Consumer Code) and hidden defects. In case of lack of conformity or hidden defect, the consumer may demand repair or replacement of the good, or failing that a price reduction or contract termination, under the conditions provided by the Consumer Code. The statutory conformity guarantee applies for two years from delivery of the good or performance of the service.
  9. Orders and payment
    1. To place an order: (1) Click "Buy"; (2) Complete the form (product, date, location, personal data, consents); (3) Optional consent to commercial communications; (4) Click "Pay"; (5) Choose payment method on the operator page; (6) Complete payment; (7) Confirmation by email with summary.
    2. An order may also be placed by email or phone.
    3. Payment is always made electronically via the payment operator to PWC's account.
    4. PWC states that the Service is provided only at locations offered in the order form.
    5. An invoice is issued for each order. The User may request a copy at any time. It will be sent to the User's active email. A copy of these Terms and Conditions is sent to the consumer with order confirmation or made available on a durable medium (e.g. customer area or by email).
  10. Complaints and dispute resolution
    1. Every User has the right to submit a complaint regarding performance of the Service by PWC.
    2. Complaints concerning payment transactions, calendar management or performance of the Service should be sent to Customer Service: support@kabinmemuru.tr or by post: Pro Wojciech Cywinski, ul. Bernardyńska 23/65, 02-904 Warsaw.
    3. Complaints will be handled without delay, and at the latest within 7 business days.
    4. The response will be sent to the User at the contact details given when submitting the complaint.
    5. The Provider reserves the right to extend the deadline in point 10.3 by up to 10 days in special circumstances or obstacles beyond its control.
    6. The law applicable to relations arising from use of the Service is Polish law. For consumers in Turkey, the French Consumer Code and French law apply regarding consumer rights. In case of conflict between a Polish provision and a mandatory French provision more favourable to the consumer, the latter prevails. French courts have jurisdiction over disputes concerning consumers in Turkey.
    7. In accordance with Article L.612-1 of the French Consumer Code, the consumer has the right to use a consumer mediator free of charge to try to resolve the dispute with the professional amicably. PWC guarantees the consumer effective access to a consumer mediation scheme. Mediation is free for the consumer. To refer the matter to the mediator, the consumer must first have tried to resolve the dispute with PWC in writing.     8. A dispute may be submitted to a mediator only after the complaint procedure is closed and both parties agree. Failing that, disputes are brought before the competent courts.
    9. The consumer may also use the European Online Dispute Resolution platform: EU ODR platform (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN).
    10. Pro Wojciech Cywinski agrees to participate in consumer dispute resolution proceedings — contact: support@kabinmemuru.tr.
  11. Personal data protection
    1. The controller of Users' personal data is Pro Wojciech Cywinski, registered office: ul. Bernardyńska 23/65, 02-904 Warsaw, who processes data in accordance with Regulation (EU) 2016/679 (GDPR) and, where applicable, French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties (French Data Protection Act).
    2. Registration and order form data are processed to take orders and perform contracts, and optionally for direct marketing. Sending commercial communications by email requires the user's consent.
    3. The controller may make provision of services and use of the Service conditional on verification of personal data.
    4. Providing data is optional. The user has rights of access, rectification, restriction, erasure, objection and complaint to a supervisory authority (in Turkey: CNIL – cnil.fr).
    5. The User must provide accurate and up-to-date data.
    6. If there is doubt about accuracy of data, the controller may block the profile and terminate the contract.
    7. The controller may disclose data to authorities or third parties only where required by law.
    8. If the User has consented to marketing — their data and activity information may be used to present advertisements from our Partners suited to their interests.
  12. User obligations
    1. Each User may have only one profile and may not share it or use another person's profile.
    2. The User undertakes not to hinder or disrupt operation of the Service. In case of breach, PWC may block the profile.
    3. The User undertakes to: (1) Comply with the law and good morals; (2) Not place false orders; (3) Pay amounts due.
    4. The User declares that all content and personal data they publish on the Service are accurate and do not violate any third-party rights.
    5. It is forbidden to use the Service for purposes contrary to its purpose, to send spam or unsolicited commercial communications, or to advertise on behalf of PWC.
    6. It is forbidden to copy all or part of the Service or use it for commercial gain.
  13. Cessation of service provision
    1. PWC reserves the right to block or delete the profile of a user whose behaviour breaches these Terms.
    2. If blocked, creating a new profile by the User requires prior consent from PWC.
    3. The User may stop using the Service at any time by deleting their profile.
    4. The controller may require the User to change password, update data and confirm consent to data processing.
  14. Changes to the Terms
    1. PWC may amend the Terms with future effect for the following reasons: (1) New Service functionality incompatible with current Terms; (2) Change required by law; (3) Change to Service functionality, in particular to improve ease of use.
    2. Registered users will be informed of any change by email at least 7 days before the effective date. Notice will also be displayed visibly in the Service for 1 day from the change.
    3. The change takes effect on the date indicated in the notice.
    4. In case of change, the user may renounce services with immediate effect.
